Who these terms apply to

These terms apply to everyone who uses Kmath. By using Kmath, you agree to them.

Who you are agreeing with

Kmath is a general partnership formed under the laws of the Commonwealth of Massachusetts. In these terms, "we", "us" and "Kmath" mean that partnership and any entity it later converts into, or transfers its business to. "You" means the parent or guardian who created the account.

If Kmath changes its legal form, for example by converting to a limited liability company or a corporation, these terms continue in force with the successor entity and no new agreement is required.

In plain words: Kmath is a small business owned by two partners in Massachusetts, and that business is who your agreement is with. If it later becomes a different kind of company, this same agreement carries over.

Which laws apply

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute arising from these terms or from your use of the service will be brought in the state or federal courts located in Massachusetts, and you and Kmath agree to the jurisdiction of those courts.

If Kmath later organises under the laws of a different state, that change applies only to matters arising after it takes effect. Anything that happened before remains governed by Massachusetts law.

In plain words: if there is ever a serious disagreement we cannot sort out between us, it is handled under Massachusetts law in a Massachusetts court. If the business moves somewhere else later, that does not change the rules for anything that already happened.

What Kmath is

Kmath is software that guides a family through math at home. It is not a school. It is not special education, and it does not replace an IEP.

Kmath works on paper first. Every family gets a Full Worksheet and a Compact Practice version. Your child does check-ins on Tuesday, Thursday and Saturday. Every 4 weeks, Kmath also re-checks the plan. We call this recalibration. It does not replace the check-ins.

The learning plan is made by Kmath SuperBrain™, a rules-based system. No AI writes your child's assessment, report or workbook.

The DCAR is an educational assessment. It is not a medical or psychological evaluation. It does not diagnose conditions. It does not replace any professional evaluation your child may need.

The DCAR assessment

The DCAR costs $69 per child. You pay it one time, before the assessment starts. The assessment has 21 questions. Early results are ready in 5 to 15 minutes. The full report is ready within 24 hours. You receive two full reports and a 52-week roadmap.

Once the report is delivered, the $69 is not refunded. Kmath does not promise specific grades or outcomes.

Price and billing

Kmath Equity sets a monthly price for each student. The price is $100 - $260 per student, per month. Your price is called your family rate. It is based on your household size, your state and your income.

• There is no registration fee.
• Each child has their own subscription and their own bill.
• The $69 DCAR is paid separately. It is not counted toward the first month.
• You pay the first month when your child's report is ready and you choose to start.
• After that, you are billed every month on the same day. Your subscription renews each month until you cancel.
• Your rate can change after we check your income documents. The next section explains how.
• Payments are processed by Stripe. Kmath never stores your full card number.

Documents and the 14-day rule

When you start, you have 14 days to send us two things:

• Your child's classroom curriculum or pacing guide. This lets the plan follow what the class is learning.
• Your income documents, if you want a family rate lower than the top rate.

We will remind you during the 14 days. If you need more time, ask us. We can give you more time.

We ask you to send your income documents within 14 days of starting. We remind you by email and in your portal. Your rate does not change during your first 30 days. If we still have not received them after 30 days, your next bill after that will be at the standard top family rate of $260 per student, per month. You can send your documents at any time. When they are checked, the correct rate starts with your next bill.

If your income documents show a higher income than you told us, your rate changes to the correct rate starting with your next bill. We do not charge you for past months. We tell you in writing before the new rate starts. If we find that a document was false, we may end your plan.

Cancelling and refunds

• You can cancel at any time in your portal.
• If you cancel before your next billing period starts, you are not charged for it.
• If a billing period has already started, it runs to its end. Your cancellation stops the next period.
• We do not give refunds. The one exception: if we charged you the wrong amount, we correct it.
• You keep access to your reports until the end of the period you paid for. You can download your reports.
• If you come back within 30 days of cancelling, you pick up where you left off and no new DCAR is needed. If your child has been away more than 30 days, they take a new $69 DCAR, because their level may have changed.
• After you cancel, or after a break of more than 30 days, we keep your child's learning records for 12 months so you can come back. After 12 months, we delete your personal data, except records the law makes us keep for accounting and taxes. Our Privacy Policy explains more.
• Kmath is a 12-month program. Leaving early means the program is not complete.

Pause policy

You can pause from your portal up to two times in any 12 months. Each pause lasts 30 days. Billing stops while you are paused. Your data and roadmap are saved. On day 30, your subscription starts again on its own, unless you cancel. We email you 7 days before the pause ends. If you need a longer break, that is a cancellation. You can always cancel and come back later.

Accounts

When a family enrolls, Kmath creates two separate accounts: one for the parent and one for the student.

• The primary parent signs in with email and password. The first sign-in uses a magic link sent by email.
• The student signs in with a unique student ID (BP-XXXXXXX) and a 4 or 6 digit PIN. The student or the primary parent sets the PIN. The child does not give an email address, phone number or home address.
• The primary parent can invite up to 5 co-parents. Each co-parent has their own sign-in.
• The primary parent can also give a teacher or IEP coordinator view-only access to the child's progress and roadmap. Teachers can upload curriculum through their account.
• Co-parents, teachers and IEP coordinators cannot see or change billing.

An adult must complete enrollment and payment before any portal is turned on.

Your responsibilities

You agree to:

• Give true information when you sign up, including your household size, state and income
• Send your child's curriculum within 14 days, and your income documents too if you want a lower rate
• Help your child complete check-ins and weekly lessons
• Keep your parent account login safe
• Keep your child's student PIN safe
• Share portal access only with the co-parents, teachers and IEP coordinators you invite

Intellectual property

All Kmath content, including reports, lessons, workbooks and parent guides, belongs to Kmath. You can use it for your child. You cannot copy, share or sell it.

Limitation of liability

Kmath is educational software. We are not responsible for academic results or school performance. Our reports are informational tools, not professional evaluations.

Changes to these terms

We may update these terms. If the changes are important, we will email you at least 14 days before they take effect.
